The team, however, is another concept. FAR`S SOUS-PARTIE 9.6 defines a contract as an agreement in which: 1. two or more companies form a partnership or joint venture to act as a potential prime contractor, or 2) a potential prime contractor is agreed with one or more other companies that they act as subcontractors under a government contract or acquisition program. It is essentially an agreement on the development of a subcontract for the specific acquisition once it has been awarded. Agencies encourage applicants to consider outsourcing. NSF writes that "companies that suggest… encourages the use of expertise and research facilities at their disposal in universities, universities, national laboratories and other research providers. These collaborations may include research contracts or consulting contracts. And the UsDA says: "The participation of academics, governments or other external collaborators in project planning and research is authorized as consultants or subcontracts, and can be particularly useful for small businesses that have not received federal research awards before." First, let`s specify what are sub-contracts, consultants and subcontractors. A sub-contract is defined by the various agencies that have SBIR programs. According to this definition, subcontracting is the agreement between the small company that applies for a SBIR or STTR premium and a third party that will assist in the conduct of the research.
The SBA allows small businesses to reallocate part of their land freeze contracts to large and small businesses, unless expressly prohibited by law, regulation or invitation. Small businesses therefore regularly use this capability using team agreements. Teaming agreements allow small businesses to maintain their standards for small businesses while benefiting from subcontracting assistance from other small businesses or even large enterprises. There, the Contractor Cooperation Agreement (CTA) allows contractors to use their GSA schedule to develop a solution for the government and does not create a separate legal entity, but allows Schedule contractors to meet the buyer`s requirements by combining the supplies and services of the separate employment contract of each team member in response to a buyer`s bid requirement. Team agreements can be a valuable tool for small businesses, allowing companies to pool resources, management skills and technical knowledge. All of these elements contribute to making a small business more competitive in the tendering process.
However, if this is not the case, the application of team agreements can have a negative impact on their ability to meet the size standards of land freeze contracts. The application of these equipment agreements poses no potential risk to contractors. False association agreements can lead to violations of SBA affiliation rules – which the SBA uses to analyze the relationship between a party fighting for a dismantling contract for small businesses and its partners, to determine whether they meet the applicable size requirements for procurement.
